An operational assistant from the Regional Secretariat for Education, Science and Technology, who since 28 December 2018 has performed duties as a technical assistant at the Regional Health Service of the Autonomous Region of Madeira, will permanently join the staff establishment of SESARAM, EPERAM. The decision is set out in Joint Order No. 100/2026, published in the Official Journal on 6 November 2026, and signed by the Regional Secretary for Health and Civil Protection, Micaela Cristina Fonseca de Freitas, and the Regional Secretary for Finance, Duarte Nuno Nunes de Freitas.

What was decided#

The order provides for the consolidation of the public-interest secondment of the worker Lilita José Ferreira Dias Mendonça. A public-interest secondment is a situation in which a worker from a public body begins to perform duties in another body while keeping their original employment link. With the consolidation, the worker will hold a open-ended public employment contract at SESARAM, EPERAM, in the career and category of technical assistant, through the creation of a post in the staff establishment.

The order takes effect on the day after its publication.

Who is covered#

The measure applies only to the worker identified in the order. The text notes that she showed interest and motivation in the consolidation, and that the Regional Secretariat for Education, Science and Technology issued a favourable opinion.

Pay, deadlines and conditions#

The law requires five cumulative conditions, but the order expressly confirms that four of them have been met: the agreement of all parties to the secondment, the existence of budgetary allocation, the favourable opinion of the regional government member responsible for finance and public administration, and a secondment lasting at least four years without interruption. According to the document, the worker has been seconded for more than four years.

As regards career, the order grants the worker 7 development points, awarded on a permanent basis, corresponding to one point for each year not evaluated. These years are those of the performance evaluations for the 2019-2020, 2021-2022 and 2023-2024 biennia, and the year 2025, a period in which no performance evaluation took place.

In addition, the worker moves on 1 January 2025 to position 2, level 8, of the technical assistant category in the salary table set out in Annex III of Decree-Law No. 84-F/2022, of 16 December. This transition results from the application of Article 3 of Decree-Law No. 75/2023, of 29 August. A further 1 point remains unused. The base salary upon consolidation corresponds to this same position and level.

The order clarifies that the recognition of career progression has no retroactive pay effects. In other words, the worker will not receive any differences relating to the period before the order took effect. The consolidation also does not entail any loss of seniority.

Background#

The joint order is an act signed by more than one member of the Regional Government, in this case those responsible for Health, Civil Protection and Finance. The legal basis is Article 38-A of Regional Legislative Decree No. 13/2019/M, of 22 August, added by Regional Legislative Decree No. 23/2023/M, of 28 June, which allows the permanent consolidation of workers seconded in the public interest to SESARAM, EPERAM. The order also invokes the General Law on Public Functions and Decree-Law No. 111/2024, of 19 December, in the salary repositioning rules applied.
