Autonomous Region of Madeira approves new land structuring legal regime
The Legislative Assembly of the Autonomous Region of Madeira has approved Regional Legislative Decree no. 7/2026/M, which adapts the national legal regime for land structuring to island specificities. The diploma aims to combat the extreme fragmentation of rustic property and promote territorial cohesion.
Key points of the new regime:
- Unit of Culture: Set at 1500 m2, with an exceptional limit of 500 m2 for cases of donation, exchange, testament, sharing, or division of common property.
- Land Consolidation: Introduction of simple and integral land consolidation modalities, aiming to improve the economic viability of agricultural holdings.
- Incentives: Establishment of tax exemptions (IMT, Stamp Duty, and IMI) for land consolidation operations and annexation of contiguous properties.
- Land Bank: Strengthening the integration of properties into the Land Bank of the Autonomous Region of Madeira for agricultural and ecological restoration purposes.
