Change Allows Paper Sick Leave Certificate in Cases of Force Majeure

A change to the regional ordinance provides for the use of a printed model of temporary incapacity certificate when electronic transmission is impossible.

The Regional Government of Madeira has amended the regime for certifying temporary incapacity for work, creating an exception for situations of force majeure. Ordinance No. 363/2026 makes the first amendment to Ordinance No. 90/2024, which adapts the national regulation of the social security subsystem for sickness protection to the Autonomous Region of Madeira.

The main change introduced is the creation of an Article 2-A, which establishes that, in case of impossibility of electronic transmission of the sick leave certificate due to force majeure, a specific printed form model must be used. This model is included in the annex to the ordinance and must observe the applicable retroactivity periods.

The form will be provided by the Institute of Health Administration, IP-RAM, upon payment of a unit price, the value of which will be set and updated by order of the member of the Regional Government responsible for the health area.

This change aims to safeguard users' rights and ensure the continuity of procedures when technical failures or other exceptional circumstances prevent the digital route, maintaining the coordination between health and social security services.
