Portaria No. 623/2026 redistributes the base price of 2,257,200.00 euros for total knee arthroplasty items, phased between 2026 and 2029.
The Regional Secretariat for Health and Civil Protection has redistributed the budgetary commitments for the acquisition of items for total knee arthroplasty, that is, the surgery to fully replace this joint, intended for the Health Service of the Autonomous Region of Madeira, EPERAM (SESARAM). The overall base price is 2,257,200.00 €, distributed across the years 2026 to 2029. The portaria was published in the Official Journal on 4 November 2026 and enters into force the day after publication.
Portaria No. 623/2026 alters the way the commitments for the acquisition were planned in Portaria No. 395/2025, of 25 July, published in the Supplement to the Official Journal, I series, No. 128, and amended by Portaria No. 393/2026, of 7 August, published in the 7th Supplement to the Official Journal, I series, No. 141. The procurement includes the placement of equipment under a commodatum arrangement, that is, lent to the hospital free of charge, without ownership passing to the entity that uses it.
The base price of 2,257,200.00 € (two million, two hundred and fifty-four thousand and two hundred euros) is subject to VAT at rates of 4% and 23%. The commitments are phased as follows:
The four amounts add up exactly to the overall base price. The portaria also provides that the amount set for each year may be increased by the balance recorded in the previous year. The 2026 expenditure will be covered by financing source 513, under economic classification D.02.01.11, of the budget of the Health Service of the Autonomous Region of Madeira, EPERAM. The commitments for the following years will be considered in their respective budgets.
The portaria refers to a three-year contract term, but the commitments are spread over four economic years, from 2026 to 2029. The text does not clarify this difference.
A portaria on the distribution of commitments is the instrument that authorises a public entity to take on expenses extending beyond one economic year. In this case, the requirement arises from Article 22 of Decree-Law No. 197/99, of 8 June, kept in force by subparagraph f) of paragraph 1 of Article 14 of Decree-Law No. 18/2008, of 29 January, and paragraph 6 of Article 23 of Regional Regulatory Decree No. 12/2026/M, of 12 June. The portaria also invokes subparagraph b) of paragraph 1 of Article 6 of Law No. 8/2012, of 21 February, known as the Law on Commitments and Arrears Payments (LCPA).
The portaria was signed by the Regional Secretary for Health and Civil Protection, Micaela Cristina Fonseca de Freitas, on 4 November 2026. The dates of the earlier instruments do not coincide throughout the text: Portaria No. 395/2025 appears dated 25 July in the summary and 22 July in the body text, and Portaria No. 393/2026 dated 7 August in the summary and 4 August in the body text. The Official Journal publication dates are the same in both parts.
