Ordinance No. 544/2026 makes a second amendment to the support scheme for PEPAC intervention F.1.7 in Madeira. The changes clarify eligibility criteria and correct rules on payment claims, while repealing the ordinance that introduced the first amendment.
The Regional Government has amended the rules governing intervention F.1.7 - Non-Productive Investments, part of Portugal’s Strategic Plan for the Common Agricultural Policy (PEPAC Portugal) in the Autonomous Region of Madeira. Ordinance No. 544/2026 of 29 September amends Ordinance No. 381/2026 of 3 August and repeals Ordinance No. 526/2026 of 15 September.
One of the changes concerns beneficiary eligibility criteria. The requirement to settle repayment obligations now expressly refers to both European funds: the European Agricultural Fund for Rural Development (EAFRD) and the European Agricultural Guarantee Fund (EAGF). Alternatively, beneficiaries may have provided a guarantee in favour of IFAP, I. P. The provision also specifies that, where applicable, beneficiaries must not have been convicted in criminal proceedings for offences involving financial resources under the EAFRD and the EAGF.
The ordinance also corrects two internal cross-references. In Article 15, the reference now points to paragraphs 8 and 9 of Article 18, concerning the deadline for submitting the final payment claim and the possibility of an extension. Article 18 clarifies that expenditure incurred before the application is submitted must be included in the first payment claim, in accordance with paragraphs 2 and 3 of Article 7.
The amendment replaces the wording published in Ordinance No. 526/2026, which, according to the new ordinance, did not fully reflect what was intended. Ordinance No. 544/2026 enters into force on the day after publication and takes effect from 16 September 2026, without prejudice to Article 141 of the Code of Administrative Procedure.
