Government Declares Public Utility for Five Expropriations for Infrastructure Works and Business Park
The Council of the Government approved the declaration of public utility for the expropriation of land needed for four infrastructure works and the regularization of the Cancela Business Park.
The Regional Government Council declared the public utility of several expropriations necessary for the execution of infrastructure works and economic development. The decisions, taken in a plenary meeting on July 23, 2026, cover five distinct processes, consolidated here as they share the same legal mechanism and objective of public interest.
The approved expropriations are as follows:
- Amendment of expropriation for the "Channeling of Ribeira da Palmeira" via Regional Government Council Resolution No. 733/2026. This resolution amends a previous one (No. 564/2026) to reflect a reduction in the area to be expropriated and an adjustment of the compensation amount to €17,400.00, accepted by the expropriated parties: Carlos dos Santos de Nóbrega married to Elisabete Maria Mendes Martins Nóbrega, Ilda Maria dos Santos Nóbrega Viveiros and husband José Nóbrega Nunes de Viveiros, José dos Santos Nóbrega, João Carlos dos Santos Nóbrega married to Elaine Gertrudis Lopez Nóbrega, Maria Helena dos Santos Nóbrega Pinto Correia and Maria da Piedade dos Santos de Nóbrega.
- Expropriation for the "Regularization of Ribeira da Lapa - near the Curral das Freiras Tunnel" via Regional Government Council Resolution No. 734/2026. The work aims to mitigate the risk of siltation that blocks access to Curral das Freiras. The land to be expropriated belongs to Sociedade do Montado dos 23 and three irrigation associations (Comissão Levada PLE Peredão, Associação da Levada dos Piornais, Associação de Regantes da Levada Nova do Curral e Castelejo), totaling 1,597 m² in Funchal.
- Expropriation for the "Construction of Weirs in Ribeira da Rocha - Serra D'Água" via Regional Government Council Resolution No. 735/2026. The work intends to build solid material retention structures for flood control. The resolution covers 21 plots in the parish of Serra D'Água, Ribeira Brava, totaling 5,867 m². The annexes indicate that it was not possible to obtain information about the owners for most of the plots.
- Expropriation for the regularization of the Cancela Business Park subdivision via Regional Government Council Resolution No. 736/2026. The public utility of the expropriation of a 140 m² rural property in Santa Cruz, necessary to regularize the legal status of the business park, is declared. The process will be conducted by MPE - Madeira Parques Empresariais, Sociedade Gestora, S.A., which will bear the costs. The property belongs to the Heirs of José Luís Quintal de Freitas.
- Expropriation for the "Rehabilitation of ER 217, São Roque do Faial - Santana" via Regional Government Council Resolution No. 737/2026. The road rehabilitation work involves the expropriation of six plots in Santana, with a total estimated compensation value of €15,027.25. The owners are the Heirs of Antónia de Freitas, Heirs of Manuel Catanho da Silva, José Paulo Gonçalves and Graça Maria Gonçalves de Andrade Gonçalves, Heirs of José Fernandes and Heirs of António Catanho da Silva Júnior.
All these declarations of public utility are based on the need to execute works aimed at the safety of people and property, protection against flash floods, accessibility, or economic development, considered to be of superior public interest.
